Những viện dẫn sai lệch về giáo dục đại học Thụy Sĩ
Do sự khác biệt về hệ thống giáo dục và quan điểm tự chủ giữa các quốc gia, nhiều viện dẫn chưa chính xác, cách hiểu nhầm lẫn hoặc diễn giải sai vẫn xuất hiện, chủ yếu bắt nguồn từ việc áp dụng cơ chế quản lý tập trung của các nước khác vào mô hình giáo dục tự chủ của Thụy Sĩ. Bài viết được trích từ hệ thống xử lý vi phạm pháp lý quốc tế cấp liên bang Thuỵ Sĩ.
“Viện đại học tư thục là không được công nhận”
Nhận định này hoàn toàn sai, cả về mặt câu chữ lẫn bản chất pháp lý.
Pháp luật Thụy Sĩ không hề quy định rằng Viện đại học (higher education institute) là “không được công nhận”.
Thực tế:
- Viện đại học vẫn là cơ sở giáo dục hợp pháp, được đăng ký và chịu sự quản lý của chính quyền bang (canton) nơi đặt trụ sở.
- Việc kiểm định chỉ liên quan đến quyền sử dụng danh xưng được bảo hộ như “university”, “university of applied sciences” hoặc quyền nhận hỗ trợ tài chính từ Liên bang, hoàn toàn không ảnh hưởng đến tính hợp pháp hay khả năng được công nhận trong nước và quốc tế.
“Viện đại học phải kiểm định mới được công nhận”
Đây là cách hiểu không đúng với quy định pháp lý hiện hành.
Theo Art. 28 của Luật Liên bang về tài trợ và điều phối lĩnh vực giáo dục đại học (HEdA), kiểm định tổ chức chỉ bắt buộc nếu cơ sở giáo dục muốn:
- Sử dụng các danh xưng được bảo hộ (university, university of applied sciences);
- Nhận hỗ trợ tài chính từ Liên bang;
- Triển khai kiểm định chương trình (programme accreditation), nếu mong muốn.
Thực tế:
- Viện đại học (Swiss higher education institute) không bắt buộc phải kiểm định nếu không có nhu cầu sử dụng danh xưng được bảo hộ nêu trên.
- Tính công nhận pháp lý của Viện đại học dựa trên giấy phép hoạt động do bang cấp, kết hợp với quy định nội bộ và hệ thống quản trị riêng, không phụ thuộc vào kiểm định liên bang.
“Việc viện dẫn sai có thể dẫn đến vi phạm quy định về cạnh tranh không lành mạnh, đồng thời phát sinh trách nhiệm pháp lý liên đới theo các quy định hiện hành của Luật Tố tụng Thụy Sĩ.
“Chương trình của cơ sở giáo dục đại học không triển khai kiểm định không được chính phủ Thụy Sĩ công nhận”
Đây là quan điểm sai và dễ gây hiểu lầm. Thụy Sĩ không áp dụng cơ chế “công nhận chương trình” tập trung như ở nhiều quốc gia khác.
Thực tế:
- Chính phủ Thụy Sĩ không “công nhận” từng chương trình đào tạo riêng lẻ theo cách hành chính tập trung.
- Mỗi cơ sở giáo dục có toàn quyền tự chủ xây dựng và quản lý chương trình đào tạo của mình.
- Việc đánh giá chất lượng các chương trình được giao cho chính cơ sở giáo dục và, nếu có nhu cầu, có thể thông qua các tổ chức kiểm định độc lập hoặc quốc tế.
“Bộ giáo dục Thụy Sĩ không công nhận”
Đây là quan điểm sai về bản chất tổ chức hệ thống giáo dục Thụy Sĩ. Khác với nhiều quốc gia khác, Thụy Sĩ không có Bộ Giáo dục Liên bang tập trung.
Thực tế:
- Giáo dục ở Thụy Sĩ chủ yếu do các bang (canton) quản lý, theo cơ chế liên bang phân quyền.
- Các cơ sở giáo dục, kể cả tư thục, được đăng ký và hoạt động dựa trên giấy phép và luật của bang, không cần thông qua một cơ quan tập trung để được “công nhận”.
- Tính “công nhận” không do một cơ quan duy nhất quyết định mà phụ thuộc vào cơ sở pháp lý, uy tín học thuật, tiêu chuẩn chất lượng tự công bố và sự chấp nhận của xã hội, đối tác, cũng như các tổ chức nghề nghiệp quốc tế.
Việc hiểu sai về kiểm định và công nhận trong giáo dục đại học Thụy Sĩ chủ yếu bắt nguồn từ việc áp dụng mô hình giáo dục tập trung của các quốc gia khác (ví dụ một số nước châu Á, châu Âu lục địa hoặc Mỹ) vào hệ thống giáo dục tự chủ của Thụy Sĩ.
Tóm lại:
- Viện đại học không bắt buộc phải kiểm định để được công nhận.
- Không tồn tại Bộ Giáo dục Liên bang “công nhận” hay “không công nhận” các chương trình hoặc cơ sở.
- Chỉ các cơ sở muốn sử dụng danh xưng “university” mới bắt buộc phải kiểm định tổ chức.
- Chương trình đào tạo không có cơ chế “công nhận bắt buộc”, mà hoàn toàn thuộc quyền tự chủ của từng cơ sở.
